FKM chief urges govt to hold dialogue

Judicial chairman of the Maluku Sovereignty Front (FKM), Simon Saiya, has urged the government to hold a dialogue in response to criticism over an incident in which South Maluku Republic (RMS) activists unfurled their flag in front of President Susilo Bambang Yudhoyono during his recent visit to Ambon. 

In a telephone interview with The Jakarta Post from Ambon on Monday night, Simon said a dialogue between FKM and the Indonesian government would give him a chance to voice his demand for recognition and the handover of RMS sovereignty rights to the Alifuru-Maluku nation peacefully through a FKM-RMS transitional government. Simon said one of the aims of the unfurling of the RMS flag by activists (who were disguised as cakalele dancers) during Yudhoyono's visit was to show the world the RMS government, which was proclaimed on April 25, 1950, still existed. "We should invite observers from neutral countries to participate in a dialogue, which (ideally) should be held in a neutral country," he said. 

"We will demand recognition and the return of our RMS freedom sovereignty rights to the Alifuru-Maluku nation before filing a report against the Indonesian government to the International Court." He denied allegations the FKM movement for RMS independence used subversive and separatist actions. Moreover, he said, the cakalele dance, which he ordered dancers to perform, was intended to prove to President Yudhoyono and national and international officials the Alifuru-Maluku people wanted freedom. Simon said the Alifuru-Maluku nation, based on history and cultural traditions, was part of West Melanesia. Therefore, it was understandable for its people to demand freedom, he said. 

"We believe the Indonesian government has violated its 1945 Constitution -- that freedom is the right of all nations." Simon said Maluku was not fully secure, due to the presence of many police officers and TNI soldiers stationed in Maluku. "The SBY government needs to have the courage to uncover who the real actors behind the Maluku conflict are and stop pitting one religion against another," he said. After the declaration of FKM on Dec. 19, 2000, Simon said he initially acted only as a sympathizer and supporter. He assumed his important post after the FKM secretary general, Moses Tuanakotta, was jailed for raising the RMS flag in front of FKM executive chairman Alex Manuputty in Kudamati, Ambon, on April 25, 2004. Simon was elected to replace Manuputty, who fled to the U.S.

Alex Manuputty: "Just Hold a Referendum" 

IT was springtime in California when Alex Manuputty first witnessed television reports about violent riots in Ambon. He was, after all, a resident of California, USA, and as such was unable to attend the raising of the flag of the Republic of South Maluku this year. Yet, as founder of the Maluku Sovereignty Front on June 15, 2001 Alex had institutionalized the flag-raising practice which he began in the garden of his Kudamati, Ambon home. He celebrated the first commemoration on April 25 the following year. "It was just a moral movement, not a revolt," he repeatedly said. 

When violence again struck Ambon last week during that commemoration, Alex was able to witness it only from afar. TEMPO reporter Akmal Nasery Basral interviewed Manuputty, who was born in Serui, Papua, 55 years ago, by telephone last Friday. 

Excerpts: 

The Maluku Sovereignty Front has been charged with being behind the recent violence. What do you say? 

I have been following developments in Ambon from television news reports. The charge that we caused the riots is untenable. We were just commemorating the April 25 Proclamation, just like previous years. We raised the flag peacefully and we read the proclamation text. This is a moral movement without violence. It's not like the Free Aceh Movement (GAM) in Aceh which is armed and actively opposes the Indonesian government. Yet we are the ones always being pressured by the government. If our moral movement is described as rebels, how would one describe GAM? 

The fact is, that commemoration triggered violence in Ambon? 

That's the logic formed by Jakarta. Did the violence take place during the commemoration? No. We were trapped and all know who did it. The role of the army and the police is significant here. Why did the authorities act the way they did to civilians? 

Three Brimob (Police Mobile Brigade) members who had just landed in Ambon were immediately shot by snipers. That meant the authorities were victims too... 

It was not only the Brimob who were victims. There were pregnant mothers, mothers nursing their babies. It was tragic. And whose work was that? Who was the sniper? 

Why must maintaining the unity of the Indonesian Republic claim so many civilian victims, innocent citizens? What logic is that? 

But isn't that kind of flag-raising forbidden? 

Who forbade it? 

The government prohibited it. 

That's how the Indonesian government works, always with bans. We are a moral movement, a peaceful movement. We do not carry weapons, so why ban us? 

Permadi from PDI-P said that supporters of the Republic of South Maluku should be arrested, even shot, not taken to the police station on foot. Do you agree? 

This puzzles me too. Before, our supporters used to be taken by truck to the police station. Why now on foot? What do they want to prove by it? It seems intentional to trap us. 

Are you still communicating with Moses Tuanakota (Executive Secretary-General of the Maluku Sovereignty Front, arrested by police-Ed.)? 

Just through other friends. I am unable to contact Moses directly. But I know detailed developments, even if it isn't through Moses. 

Is the issue of the Republic of South Maluku getting a lot of positive response from the people 

Let's say this. Lets do away with diplomacy, negotiations and such things. They are just a waste of time. Just hold a referendum, let the people speak out and vote. That's more effective. Why is the government afraid of doing that? Why can the government do that with East Timor but not for the people of Maluku? 

Are you certain such an option will be accepted by the government? 

The Indonesian government should be more serious about what is happening in Ambon. Many civilians were killed. Don't just think about the elections, legislature candidates or who will be president. If the Ambon case is allowed to go on endlessly, and continue to attract international attention, observers will arrive there and the government will lose out. With a referendum, the problem of Maluku will be solved comprehensively. 

Which presidential candidate is capable of accommodating such aspirations for a referendum? Do you expect certain persons to win? 

I don't know. Whoever becomes president must think seriously about referendum and not always blame the Front for problems in Ambon, when there's clear evidence that it's the fault of the Indonesian government.

Grotius dalam bukunya yang terkenal De jure Belli ac Pacis mengatakan bahwa : 
“ Kebangsaan/Warganegara dalam suatu Negara yang mematuhi hukum-hukumnya adalah Kebangsaan/Warganegara yang tidak bodoh alias Pintar”, Warganegara yang melanggar hukumnya sendiri untuk mendapatkan kepentingan Segra, akan menghancurkan kepentingan diri dan anak cucunya di masa depan yang sebenarnya dijamin oleh hukum tersebut apabila tidak dilanggarnya… Jadi Warganegara yang melanggar hukum-hukum Dasar dan hukum bangsa-bangsa juga turut menghancurkan benteng yang menjamin kedamaian masa depan diri sendiri. 

Mari katong lia korelasi dari pengalaman pernyataan ini dengan keadaan Indonesia dewasa ini !,… 
Apabila Republik Indonesia (RI) Yogya dan sekitarnya tidak serakah pada saat itu (Dekolonisasi), maka RI tetap jaya sampai hari ini untuk menjamin kelangsungan hidup anak cucunya, karena hukum-hukum menjaminnya, tetapi karena dia melanggar hukum/constitusi-nya sendiri dan hukum bangsa-bangsa pada saat itu (Perjanjian dekolonisasi) untuk mendapatkan kepentingan segra,… Apa itu kepentingan segra, …tidak lain tidak bukan adalah se-mata-mata Negara Kesatuan Republik Indonesia (NKRI), alias kepentingan jawa, maka adalah sangat jelas sekali sekarang ini bahwa mereka sementara menghancurkan kepentingan/kedamaian masa depan diri dan anak cucu mereka sendiri,… dengan kata laeng yang popular bahwa apa yang mereka tanam dulu sekarang mereka sementara MEMAKANNYA !, … artinya bahwa apa yang mereka lakukan dulu adalah merupakan BUMERANG bagi diri mereka sendiri sakarang ini… 

Apa yang dikerjakan oleh Republik Jawa dengan antek-anteknya adalah merupakan LINGKARAN SETAN yang mengejar diri mereka sendiri. 

Basudara Bangsa Maluku/Alif’Uru/Ina !, semakin mereka ketakutan kepada Republik Maluku Selatan (RMS) 25 April 1950, maka semakin giat mereka melakukan hal-hal yang melanggar hukum, dan semakin mereka melanggar hukum semakin kuat pula mereka ketakutan,… Hal-hal seperti ini bajalang tarus sampai akhirnya tiba pada suatu JURUS TOBAT , yaitu seng ada obat par akang lai, karena luka semakin parah dan musti diamputasi alias bubar atau mati dengan sendirinya (Negara bubar). 
Pattimura Muda selalu bangkit sejalan dengan Zaman untuk membela kebenaran,… kebenaran yang mana itu eee !, me katong pung kebenaran jua kiooo !, seng bisa Rai kang lai ka,…!. 

Dolo waktu Pattimura,… maka ada banyak paskali Kapitan pembela kebenaran, tetapi bersamaan dengan itu ada Penghianat/Penjilat lai,… akang seng beda jauh dengan sakarang ini,… akang sama sa,… Penghianat/Penjilat juga ada sakarang ini,… Balagak jadi Pahlawan ada juga, mar kesiangan !; sakarang ini Dalih-Dalih dalam perjuangan banyak paskali, ada yang bilang bagini la,…! ada yang bilang bagitu la,… ada yang su bajalang kamuka mar masih menoleh kabalakang,…! Dan ada banyak rupa-rupa cara yang kelihatannya membangun perjuangan namun pada Hakekatnya justru meruntuhkan perjuangan itu sendiri.

Pattimura deng RMS itu sama, artinya Pattimura itu RMS dan RMS itu Pattimura, karena RMS 25 April 1950 itu adalah Pattimura-Pattimura Muda yang bangkit melawan PENJAJAH INDONESIA/JAWA. 
Pattimura deng Front Kedaulatan Maluku (FKM) itu juga sama; Kalau dolo Pattimura bangkit melawan Penjajah Belanda dengan antua pung PROKLAMASI HARIA (14 butir), maka sakarang FKM bangkit melawan Penjajah Indonesia deng katong pung Deklarasi 18 Desember 2000 kiooo.

We the people of the Republic of South Moluccas want to deliver to the United Nations, the World Communities, the Kingdom of Netherlands and the Government of Indonesia the following petition: 

PETITION 

1. The world community should admonish the Indonesian leaders that they do not recognize Indonesia’s sovereignty over Maluku. 

2. The United Nations Commission on Human Rights and its Sub- Communications should, directly through specific resolutions and indirectly through the reporting of thematic rapporteurs, address the situation in Maluku, including the presentation of the numerous and serious human rights and humanitarian law violations perpetrated by the government of Indonesia and its military forces in Maluku. 


3. The United Nations should address the situation in Maluku as one of a non-self-governing territory and should accordingly place Maluku under the trustee system of the United Nations until a plebiscite is held which determines the wishes of the Moloccan people. 

4. The struggle of the South Moluccan people for the last 60 years which include the Transitional Government FKM (Front Kedaulatan Maluku)/ RMS that was established on December 18, 2000 in order to resist against Indonesia’s occupation, which was the manifestation of the RMS(Republik Maluku Selatan) government itself, proclaimed on April 25,1950 obviously need to be resolved by the International Court, because this dispute is an International case and the position of the Transitional Government of FKM/RMS/People’s struggle fall under the domain of international jurisdiction. 


5. The United Nations International Human Rights & Political apparatus as an authoritative organization must demand the release of all RMS “prisoners of conscience” that are currently suffering from torture and other cruel, inhuman or degrading treatment inflicted by the government of Indonesia. 


6. Promptly establish an International and independent investigative 
team in the South Moluccas and the entire Moluccas territory. 


7. The United Nations continue to put the RMS case in the back burner for the last sixty years and ought to reopen the case so it will be beneficial to its just owners. 


8. The government and kingdom of the Netherlands should not wash their hands and are not immune from Her responsibilities and actions that lead to the suffering of the Moluccan people. Instead She needs to take the initiative and facilitate the return of RMS and restore its status to April 25, 1950. 


9. The United Nations must facilitate or assist the progress of the RMS struggle that have been conducted with peace and tranquility thus complying with civil right laws granted by International law as well Indonesia’s own human rights law number 39, 1999. 

10.Rather than carrying out their policy of “Final Solution” by annihilating 
the Moluccan People, Indonesia should promptly establish practices 
that is inline with civilized and courteous societies by implementing 
initiatives that leads to a fruitful dialog with leaders of the FKM/RMS 
transitional government. 


CONCLUSION: 

The government of Republik Maluku Selatan was a legitimate government and was wrongly overturned by the government of Indonesia. The Moluccan people are entitled to the exercise of self-determination because this was explicitly granted them by history and express agreement of the governments of the Netherlands and Indonesia and acknowledged by the United Nations. The government of Indonesia illegally occupies Maluku and should withdraw its people and military forces immediately. The people of Maluku should be given the opportunity to reorganize their government in Maluku or, if it is their wish, to indicate by plebiscite or other means of free choice, their wishes for their governance. The government of the Netherlands and the United Nations as a whole should carry out initiatives to restore the right to self-determination to the Moluccan people.

Dear Sir, 

For commemorating the 53rd anniversary of the Proclamation of Independence of the Republic of South Moluccas, April 25, 2003, that Front Kedaulatan Maluku (Moluccas Sovereignty Front) would raise the flag of the Republic of Moluccas, Benag Raja, as a manifestation of the struggle that really counts on morality and democracy. 

For this objective we shall raise the flag of the United Nations as to honour and also to request the UN to seriously pay any deep attention to the torment of Maluku / Alif’uru / Ina nation of West Melanesia race that is still colonized by other nation (the Unitary States of Indonesia), in which it has by any tricky deceive turns the facts up side down. 

For an additional information, we shall like to say that in 2001 FKM really did an inauguration to commemorate the 51st anniversary of independence by raising the Benang Raja flag, the UN flag, and Indonesian flag. After being raised for a while these flags were taken down by the police and they took them. 

Therefore, in this year we really request for any serious attention and preventive action of the United Nations in order to keep the flags raised in the air and may not be taken down by any persons, for the raising of the flag really reflects the desire and commitment of a nation in fighting for the right peacefully and morally. 

We are humbly looking forward to having any serious attention and follow up performed by Your Honorable for the case of Maluku. 

We shall like to express our sincere gratitude.
